Cruise line not liable for child-passenger’s traumatic brain injury

A Miami federal judge recently granted a cruise line represented by us summary judgment in a case involving allegations that a four-year-old passenger suffered a traumatic brain injury after falling through a deck guardrail. The firm proved that the guardrail was reasonably configured since it met or exceeded every applicable safety standard and regulation. The federal judge found that the passenger’s parents could not show any negligence on the cruise line’s part as a matter of law. Read the Order here.
